HOW IS THE PURCHASE PROCESS IN SPAIN?

Buying a property in Spain is quite a precise process, and we assist our clients throughout the entire process until the new ownership is registered in the Land Registry.

WHAT DOES OUR SERVICE INCLUDE?

We provide our clients with a fixed fee, including a complete and personalized assistance along the process, and always attending to their needs.

Our service includes the previous requirements, such as the issuing of the NIE number and the opening of a Spanish bank account. Of course, we do also carry out the legal searches on all the different aspects of the transaction and, after completion, we pay the taxes and change utilities, community of owners and taxes at the buyer´s name.

We do also provide our clients with the following information and documentation before the signature of the private contract:

  • Legal searches and Complete Report. We request the property´s documentation to the vendor´s representative, and initiate our legal searches on all the aspects of the transaction, such as the good title of the property, land registry information, charges and encumbrances, urbanistic situation and first occupation license, cadastral information, community of owners, IBI Tax and Rubbish collection, utilities…
    All these aspects are informed to our clients in a Complete Report, including the result of the searches, and of course any contingency found and its remedies. It is a very useful document and very helpful in the future, as it comprises all the relevant information, contact details, payment periods…
  • Breakdown of taxes, costs and expenses of the purchase. There are some costs and expenses to bear in mind on top of the price, and we provide our clients with a detailed breakdown that clarifies the final and total cost of the transaction. Some of these costs are: Transfer Tax or VAT, Stamp Duties if the case, Notary Fees, Land Registry Fees, Legal Fees…
  • Tax advice. It is important to define the best way to acquire the property (as natural person, with a Spanish company or with a non-resident Spanish company) in order to minimize the tax impact of the acquisition. We carefully analyse our client´s circumstances and provide the different alternatives, and its tax impact, to make sure they make the best decision.
